Ecomobile – Aluguer de Viaturas Automóveis, Sociedade Unipessoal, Lda. (hereinafter referred to as Ecomobile - Rent a Car) with its registered office at Rua da Aldeia, 375, Paços de Brandão, 4535-279 Paços de Brandão, rents to the Person (s) identified in the Rental Agreement (hereinafter referred to as “Customer” or “Driver”) the vehicle described in the Rental Agreement (hereinafter referred to as “Vehicle”), in accordance with the Rental Terms and Conditions described below and or in any attachment, in which the Customer knows and accepts and, upon signing, undertakes to observe and respect.
1. Age and category of driving license
The Driver must be at least 18 years old and have a valid driving license;
Ecomobile – Rent a Car will always make every effort to provide the vehicle reserved for the rental period. If for any reason Ecomobile – Rent a Car is unable to provide a reserved car group vehicle, another equivalent or higher range vehicle may replace the reserved car group vehicle. If the replacement vehicle rate is higher than the car group vehicle originally booked by the Customer, this difference will be supported by Ecomobile – Rent a Car.
3. Vehicle pick up and delivery
The pick-up and drop-off of the vehicle must be at the address, day and time specified in the Specific Conditions of the vehicle’s Rental Contract. The returning of the car to another Service Station may incur an extra charge.
The car availability will only be automatically confirmed when you pay online at the time of the booking on the Ecomobile – Rent a Car website. If the Customer chooses to book without making, in whole or in part, the payment, Ecomobile – Rent a Car is not required to make available the desired vehicle or other similar.
If the Customer wishes to extend the rental period, he must inform Ecomobile – Rent a Car at least 24 hours in advance. Depending on the fleet’s availability, Ecomobile – Rent a Car may or may not authorize the extension of the rental period.
If the extension of the rental period is not requested and the vehicle is not returned at the address, date and time stipulated in the Rental Contract, it will be considered unlawful use of the car and Ecomobile – Rent a Car reserves the right to charge an amount calculated on the basis of three times the desk daily rate.
4. Ecomobile – Rent a Car’s Responsibilities
Ecomobile – Rent a Car must deliver the vehicle in good condition and maintenance and in safe driving conditions. The Customer must receive all vehicle documentation (Authenticated Photocopy or Original of the Vehicle’s Registration, Vehicle’s Insurance and the Accident’s Statement Form) as well as accessories / related contracted.
Ecomobile – Rent a Car must check and register in a form, to be delivered to the Customer, the damages of the vehicle upon its delivery.
5. Customer Responsibilities
The Customer is responsible for ensuring that it has a valid Driving License to drive the vehicle it proposes to rent. The originals of the Driving License and Identity Card or Passport must be presented by the Customer.
During the rental period, the Customer is responsible for all fines and violations of the Highway Code or other violations of the law. Ecomobile – Rent a Car is responsible for informing the Customer Identity or giving other information to the Portuguese or Foreign Authorities whenever requested.
It is the Customer's responsibility to ensure that the rental vehicle:
• Will be used according to the manufacturer's recommendations;
• It will be used in full compliance with the Road Code of the country in which it circulates;
• Will not be used negligently;
• Will not be used in sports competitions or others;
• Will not be used off the road or off any conventional roads;
• Will not be used for illegal reasons;
• Will not be used heavier than its authorized capacity;
• Will not be driven by anyone not mentioned in the Rental Agreement;
• Will not be used if its mechanical condition is considered unsafe;
• Will not be used on the effect of alcohol, drugs or other narcotic substances;
• Will not be used if Customer's physical condition is weakened by illness or tiredness.
The failure to comply with any of the preceding paragraphs involves the immediate termination of the Insurance making the Customer fully liable for the total value of the vehicle.
The rental rate includes the following insurance coverage:
• Mandatory Civil Liability;
• Travel Assistance (Mainland Portugal and in Conventional Countries);
• Collision Damage Waiver with Excess Amount.
Under no circumstances does the Collision Damage Waiver covers the damage or loss of the rented accessories such as GPS, baby seats, etc.
7. Via Verde Management Service (tolls)
The Base Rental Rate automatically includes the Via Verde Management Service (tolls), which requires the Lessee to provide a Credit Card or, alternatively, another means of payment that Ecomobile – Rent a Car deems more appropriate and convenient.
7.1. By automatically subscribing to the Toll Service, which is already included in the Base Rental Rate, the Lessee subscribes to the respective service for the amount of €1.55 + VAT = €1.91 per day, up to a maximum of €15.55 + VAT = €19.07, obviously plus the respective toll value. (Ordinance No. 190/2013 of May 23).
8. Cancellation of Reservations
The reservations made through the Ecomobile – Rent a Car website may be canceled by Ecomobile – Rent a Car itself or by the Customer as long as the cancellation requests are made at least 48 hours in advance. For the Customer to use the cancellation of your reservation, you must always contract the Reservation Cancellation Supplement which is available at the time of booking in the selection of "Other Coverages (greater protection)". Therefore, if you wish to use the Reservation Cancellation Supplement you can access the "Private Area" to cancel your reservation, or contact the Ecomobile – Rent a Car Reservation Center at (+351) 256 100 261 (national call) or by the email address firstname.lastname@example.org.
No cancellation fee will be charged for all return requests made more than 48 hours in advance.
9. Return Policy
The payments returns made are automatically issued when the cancellation request is made. Whenever possible the return should be made by the same payment method, but if it is not possible, the User must provide the proof of payment and Account or Card Ownership, to make the return by bank transfer.
Ecomobile – Rent a Car undertakes to return all amounts received (except bank or other fees and the Reservation Cancellation Supplement) within a maximum of 5 business days.
No refunds will be made if the rental ends earlier, if the Customer does not show up to pick up the car or if the reservation is canceled less than 48 hours in advance.

10. Fuel Policy
The Customer may contract one of the 3 solutions that the Rental Company offers.
10.1. In 1st solution – Deposit Full -> Empty / Full -> Empty Tank, Ecomobile – Rent a Car delivers to the Renter the vehicle object of the Rental Agreement with the full deposit. The Client will have to settle the amount corresponding to the solution presented, according to the car group of the vehicle object of the Rental Agreement. The 1st solution conditions “Full Tank -> Empty / Full -> Empty Tank” are as follows:

b) The Customer will not have to refuel the vehicle before returning it to Ecomobile – Rent a Car. That is, you can return the car with the fuel level you have at the time of return, even with low fuel;
c) The "Deposit Full -> Empty / Full -> Empty Tank" solution already includes the fuel due for the rented car, the Ecomobile – Rent a Car personnel service for the refueling both at check-out as at the time of return (check-in), eventual refuel fee (s) and taxes;
d) If the Customer returns the car with fuel that was not used, Ecomobile – Rent a Car will not refund in any case. The Customer will also not be entitled to any refunds if you have refueled at a certain service station or petroleum products brand for less than the price you previously contracted with Ecomobile – Rent a Car;
e) In the event that the Client contracts the SCDW, the “Deposit Full -> Empty / Full -> Empty Tank” solution is only allowed if the Toll Management service is contracted (“Toll Management”) also available by Ecomobile – Rent a Car;
10.2. If the Customer does not contract the “Deposit Full -> Empty / Full -> Empty Tank” solution or the solution “Deposit Full-> Flex / Full-> Flex Tank”, you are automatically facing the 2nd solution – Deposit Full -> Full /> - Full Tank, which is responsible for always returning the vehicle with the same fuel level as when the vehicle was delivered. Usually at Ecomobile – Rent a Car all cars are rented with a full deposit. In the 2nd solution the Customer is required to provide a fuel deposit, either in cash or by credit card, through the contracted car group, and, upon return of the car to Ecomobile – Rent a Car is required to deliver a proof of refueling from a service station within a maximum radius of 10 kilometers from the return point with its registration. When the vehicle is returned at a lower fuel level than at the time of delivery, the amount of the missing fuel plus any costs will be charged by Ecomobile – Rent a Car to the Customer. Ecomobile – Rent a Car may require the payment of a fee / supplement to the Renter for the refueling of the vehicle up to a maximum of €30.00 (thirty euros). The fuel deposits per car group for the “Deposit Full -> Full / Full -> Full Tank” solution are as follows:

10.3. In case the Client does not contract the solutions “Deposit Full -> Empty / Full -> Empty Tank” and “Deposit Full -> Full / Full -> Full Tank”, there is also solution no. 3 – Deposit Full-> Flex / Full-> Flex Tank, in which the Customer receives the car with the deposit full and when returning it you do not have the responsibility to refuel the fuel tank. Just return the car with the fuel level that is has at the time of the delivery that Ecomobile – Rent a Car will be responsible for the refueling of it, charging in the credit card of the Customer the amount corresponding to the refueling plus its fee / refuel service supplement in the amount of €15.00 (taxes included). This solution implies that the Customer provides the Credit Card details for subsequent refueling and for the refueling service supplement in the amount of €15.00 (taxes included) by Ecomobile – Rent a Car.
11. AdBlue® Policy
11.1. Ecomobile - Rent a Car advises that the Lessee must return the vehicle with a full tank of AdBlue® for any rentals lasting 28 days or more. If the vehicle is not returned with a full tank of AdBlue®, the Lessor will charge the Lessee for the cost of filling the vehicle plus a service charge in accordance with the price list applicable at the time of rental. The applicable price list is displayed on the Lessor's premises and website. For rentals with a duration of 27 days or less, the Lessor will handle the AdBlue® refill variably, charging, depending on the number of kilometers travelled, the AdBlue® value plus a refueling fee. The applicable price list is displayed at the Service Station/Desk and on the Rental Company's website;
11.2. When picking up the rented vehicle, the Lessee must ensure that the AdBlue® tank is always sufficiently full;
11.3. The Lessee and/or its Agents/Drivers/Representatives are fully responsible for the breach of the aforementioned obligation during the rental period;
11.4. The Lessee shall indemnify the Lessor against all claims, in particular against any penalty and warning fines, claimed by the Authorities or other Third Parties, as well as for any failure/error in filling the AdBlue® tank.
12. Mechanical breakdown
In the event of a mechanical malfunction, the Customer should contact Ecomobile - Rent a Car and the Road Travel Assistance at (+ 351) 800 201 833 (national call), if the insurance policy is from Allianz Portugal and if you’re in Portugal, or (+351) 213 129 210 (national call), if the insurance policy is from Allianz Portugal and you’re abroad, stating your exact location and detail the type of malfunction as best as possible. If the repair is not possible, Ecomobile – Rent a Car or the Road Travel Assistance will endeavor to replace the damaged vehicle in the shortest possible time.
13. Georeferencing Equipment
The Customer acknowledges that the vehicle may be equipped with a georeferencing device that may be used in the event of non-compliance with the Rental Agreement, theft or border crossing.
All the transactions made through the Ecomobile – Rent a Car website, whether by ATM, PayPal or direct payments by credit or debit cards (Visa and MasterCard) are processed by an external company called Easypay (www.easypay.pt).
In the event of a dispute between the Customer and Ecomobile – Rent a Car, this will be regulated in accordance with the Portuguese Laws. Both Customer and Ecomobile – Rent a Car agree to establish the Santa Maria da Feira judicial district court to resolve any disputes arising from the Rental Agreement or the Customer may have recourse to an Alternative Consumer Dispute Resolution Entity (see more in Questions and Answers and HERE).
General Note on Credit Cards
Virtual Credit Card is not allowed to make the deposit. A Physical Credit Card is required to pick up the car.
